Mediation
Mediation is a process by which an impartial person, the mediator,
facilitates communication between the parties to a dispute to promote
reconciliation, settlement or understanding among them. The mediator
may suggest ways of resolving the dispute, but does not impose her or his
own judgment about the issues upon the parties.
There are no hard and fast rules of procedure for the mediation process,
and this flexibility allows the mediator and the parties to find the most
effective and efficient method to resolve the conflict.
Some of the benefits of mediation include:
- Win-Win Outcomes
- Predictability of Outcomes
- Personal Empowerment
- Workable Solutions
- Higher Rate of Compliance
- Protecting Relationships
- Mediated Agreements are Customized
Unless the parties are participating in mediation by court order,
mediation is a voluntary process. Regardless of the manner in
which the parties arrive at mediation, however, the ultimate solution to the
problem is determined by the parties and no one is forced to enter into
solution to which they do not agree.
